Terms of Service

Welcome to FormVidya. These Terms of Service ("Terms") govern your use of the FormVidya website, the FormVidya mobile application, and any related services (collectively, the "Services") operated by FormVidya ("Company," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the Services, including visitors, registered users, and any other persons who access or use the Services.

FormVidya provides fitness form analysis technology through the FormVidya mobile application. Our Services include:

To use certain features of the Services, you must register for an account. When you register, you agree to:

4. SMS and Messaging Consent

You consent to receive an SMS when you tap the button that sends it — not by creating an account. Each verification message is one you asked for, on the number you typed, at the moment you asked. We never add a number to a list you did not opt into yourself.

Messages are sent only when you initiate a sign-in or an account action that requires confirmation. We do not send marketing or promotional text messages.

Message and Data Rates

Standard message and data rates may apply depending on your mobile carrier plan. FormVidya is not responsible for any charges incurred from your carrier for receiving SMS messages.

Opting Out of SMS

You may opt out of SMS messages at any time by:

Verification codes are the only SMS we send, so opting out means we can no longer text you one — you would need to sign in by email instead. Opting out never stops you using the Services; it stops the messages.

Delivery

Delivery depends on your mobile carrier. Carriers may delay, filter or fail to deliver messages, and are not liable when they do.

The Services are intended for informational and educational purposes only. FormVidya is not a medical provider and does not provide medical advice, diagnosis, or treatment. The exercise form feedback provided by the FormVidya app is generated by computer vision technology and should not be considered a substitute for professional guidance.

7. Intellectual Property

The Services, including all content, features, functionality, software, code, designs, text, graphics, logos, and trademarks, are owned by FormVidya and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

8. User Content, Recordings and Session Data

You retain ownership of any content you submit through the Services, including videos you upload and profile information. By submitting content, you grant FormVidya a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content for the purpose of providing the Services to you. We also use your session data to support you and to improve our analysis, as described in our Privacy Policy.

You represent that you have the right to submit any content you provide and that such content does not violate any third party's rights.

8.1 We do not keep a recording of your workout

When you work out with one phone, the camera images stay on your device; it sends body-position points, not images, to our servers, where your form is analyzed. Pictures from a separate camera — a connected camera device, or a second phone set up as the camera — pass through our servers and are not stored.

A diagnostic record of that body-position data is created automatically for every session and kept for 14 days, as described in Sections 1a and 6 of our Privacy Policy. There is no setting that turns it off.

8.2 Recording a workout on your phone

You may choose to record your workouts. Recordings are saved on your device and are not sent to us; the app deletes each one 30 days after it is saved, the next time you open the app. A copy you export to your photo library belongs to you. Deleting your account removes the recordings the app holds on the device you delete it from.

8.3 Sharing a session with a professional

You may share a session with a trainer or other professional you work with through the Services. You choose the session and confirm before anything is sent. When you connect with a professional, you explicitly choose what to share. You can choose to share all the details of the assignments your professional gives you, including results, the movement trace and video. Nothing is shared unless you choose it. Contact us and we will remove a shared session.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of information as described in the Privacy Policy.

To the fullest extent permitted by law, FormVidya shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that the exercise form analysis will be accurate or complete.

13. Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Services will immediately cease.

You may delete your account at any time through your account settings or by contacting us.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, providing additional notice (such as an in-app notification or email). Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which FormVidya is incorporated, without regard to conflict of law principles.
